California senator produces drug panel taken day after DUI citation

SACRAMENTO, California — State Sen. Sabrina Cervantes on Wednesday released the negative results of a urine test done the day after she was cited for driving under the influence came back clean, offering them up as proof that she had been wrongly accused.
“The accusation that I was driving under the influence is utterly false,” Cervantes said in a statement to . “I take this matter seriously and in the interest of transparency, I am releasing my hospital exam report and hospital lab results.”
The Sacramento Police Department said Wednesday that officers who met Cervantes at a nearby hospital Monday suspected that the lawmaker was under the influence of drugs when the car she was driving was involved in an afternoon collision with another vehicle. They did not specify what measures they took to come to that conclusion.
Cervantes provided with results from a urine drug screen showing that a sample from the lawmaker came with undetectable levels for a list of drugs including cocaine, THC, and opiates. The report indicates the sample was taken at 4:47 p.m. on May 20, over 24 hours after authorities said they responded to the crash in Sacramento.
“The Sacramento Police Department’s accusations are unjust and hold no truth. Again, I expect this matter to be quickly and justly resolved,” she said in a statement.
Cervantes also provided a hospital exam from the day of the crash, although it included some redacted sections. A doctor from South Sacramento Kaiser Medical Center said that the senator stated she was T-boned on the passenger side of her car by another vehicle and complained of lower back, hip and knee pain. The exam notes that she was not prescribed any medication and that her blood alcohol level was less than .01 percent.
The Sacramento Police Department took its own blood sample after meeting Cervantes at the hospital. It has been sent to the county’s crime lab and has not been returned with results. The Sacramento district attorney said the office will wait for results before making a decision about whether to charge Cervantes with a DUI.
Senate President Pro Tem Mike McGuire expressed support for Cervantes Wednesday and said authorities needed to resolve the issue “as soon as possible.”
“Senator Cervantes is a fierce advocate for her community and our state and I am proud to call her a friend. I stand by her in this difficult time,” he said.
